Is Delta-9 Legal?

So... is Delta-9 THC legal?
Yes — but also no — but kind of yes. (our expensive lawyers won't let us give you a definite answer).

In 2018, the U.S. government passed the Farm Bill, which basically legalized hemp and all its components, as long as the Delta-9 THC content is less than 0.3% by dry weight. So if a gummy, drink, or edible is made with hemp-derived Delta-9 and follows that 0.3% rule? Congrats, it’s federally legal. That’s the loophole that made this whole industry pop off.

BUT WAIT... some states are doing their own thing
Just because Uncle Sam says Delta-9 is cool doesn’t mean your state agrees. Some states are out here banning it. Some are regulating it. Some are like “meh, we’ll get to it later.” The law is literally changing every week.

So while Hey Binx is Farm Bill certified and technically legal at the federal level, your state could still hit you with a “nah.”

It’s giving ✨legal limbo✨.

What should you do?
Honestly? Be nosy. Google your state’s laws. Check with your local dispensary. Look for brands (hi babes, it's us) that are transparent and compliant AF. Don’t assume it’s legal just because it’s in a bougie wellness store next to the mushroom coffee and sage bundles.
